Evelyn, I have some questions about the discovery
examinations. Please do not post this if I cross into
forbidden territory. Will the results be made public as
they were with the former Town lawyer's exam ? And
are you allowed to discuss the attendees? The cast
of characters?
Can you report on side snide comments that were
off the record and aimed at you or your lawyer ? Did
you develop a head ache?
************************
And the last shall be first. I did not develop a headache.
The discovery examinations are not complete. Wednesday was my examination. In Mid-August the six defendants will be examined separately.
I swore on a bible to tell the truth. The record is transcribed. I think the procedure will be a matter of public record, but only when complete. I think there may be another process before court proceedings.
There were no snide comments.Nothing is allowed to interfere with the process.
The venue was a relatively small board room. At the table were four lawyers, the court reporter and myself. I was the focus of attention.
On the table were piles and piles of documents in folders the court reporter's equipment. A lawyer with the defendant's lawyer, had a lap-top. My lawyer had a lap-top. Metroland's lawyer was there. I'm not sure if there was a third lap-top.I couldn't see over the forest of lap-tops.
It just occurred to me,if my mother was reading this she would have no idea what is a lap-top, why would a lap-top be on a table top and why would it be a sight barrier.
The perimeter of the room was crowded with document carriers and boxes A table in the corner had a thermos of coffee, cream, sugar, cups and spoons.
My walker with its own basket of documents, which I didn't need , was in a corner.
Attending were four defendants. Messrs Morris and McEachern stayed the whole day, Gaertner and Wilson left halfway through.
Morris brought a walker and sat on it. Wilson found room to sprawl just as he did in the council chamber for four years.
The end wall was windowed and that made a positive difference.
We started at ten and finished at five.
It was a new and interesting experience.
Very satisfying
But what does one wear to attend such an
ReplyDeleteevent? Do you get all spruced up and
polished?
Maybe this time you caused the headaches.
ReplyDeleteThat would be a refreshing change from the
pattern of the past. Shoe, Fits, Wear ! Well done!
Dear Evelyn:
ReplyDeleteThanks for showing some of the inner workings of a part of the legal system. Obviously without lap-tops it couldn't function. Retired lawyers must feel a touch jealous about the technology that was not available in their heyday.
Presumably all three defendant lawyers are representing one or another insurance company. Are they seasoned veterans or in the early stage of their careers?
It was wonderful to read the last two words of your post.
Hope your satisfaction continues to grow throughout.

Who is paying?
ReplyDeleteWhat's the point?
E, Your life would blow your Mom's socks off!
ReplyDelete"THE" point? Where have you been living for the
ReplyDeletepast 4-5 years?
Congrats.
ReplyDeleteI hope these bullies get what they deserve.
Especially Wilson who has been aggressive with citizens of Aurora.
The one point of many with which most people
ReplyDeleteseem to agree is ' Thou shalt not bully".
A lot of us hoped that they would see the light
ReplyDeletewhen more than10,000 people hauled themselves
to to polls to vote for someone other than Morris for
Mayor and to remove Mormac from control. But
they couldn't and wouldn't back off...they just keep
on inflicting damage. No sign of regret. The new
Mayor apologized for the mess he had not created !
Don't they know their own lawyers think they are a
bunch of nut-bars ?
Town insurance is paying one team of lawyers,
ReplyDelete( your money ). Evelyn is not using your money,
although in retrospect maybe she should have
done that.
There are people in town who are trying to
assist Evelyn. I doubt if she will post this, but you
should know that the drain is heavy and sometimes
frightening. Address is in the phone book.
To put the cost factor into play, consider what is
ReplyDeletepaid to the Cultural Center and the supposed Arts
Festival and the $100 an hour that Ballard wanted
for his Gala tickets......then place it next to the
cost of Evelyn to the town, which has been nothing.
Oh, and all the expenses of the former and not
so former councilors are being paid by you !
So from where is the sucking sound originating?
Regarding the comments about the costs. The suit, initiated by Ms Buck is being paid by her and her financial supporters. The defence is paid by the Town's insurance which is paid by the tax payers. No doubt the insurance premiums will go up after this - so the poor tax payer gets screwed again while egos fight in the court room. Most residents have forgotten - if they ever knew - that this thing is even going on. So much has happened since.
ReplyDeleteDo you think any of them have actually seen an
ReplyDeleteitemized lawyer's bill ? That might make them take
notice. Even better would be if they had to cut
a check on a regular basis. It is easy to spend other
people's money when it is not there is black and white,
dripping blood onto your table.
Why did Phyllis have the walker??
ReplyDeleteWas it a "PITY PARTY??"
Keep your chin up Evelyn!!
Surely the truth and common sense will prevail.
