I probably could not say if the Town was being sued but I probably can say the town is not being sued.Not that I know or need to know about.
The question I raised on Tuesday about the agenda item of an in-camera discussion, related to Council authority to waive confidentiality, on the part of two town officials who may be called to testify, in the matter of a Charge of Conflict of Interest filed against former Mayor Phyllis Morris, in the matter of whether or not she participated in discussion and vote on retaining legal counsel on her own behalf, at town expense, to sue three citizens for negative comments, made against her by anonymous posters
The suit was for 6 million dollars to be paid to her benefit . Two opportunities to sign undertakings to compensate the town for legal costs, should the suit be successful were missed.
The in-camera meeting was held on September 14th 2010. The election campaign had already begun. The motion prepared prior to the meeting, instructed the town solicitor to take" whatever action was necessary" to resolve the situation.
Litigation was commenced without further involvement of council.
Two residents sued have received a payment for part of the legal costs. They are litigating for the remainder which I understand is in an amount of $70,000. or thereabouts.
The town paid bills in an amount of $55,500 for the solicitor retained by the former Mayor and $8,300 for a solicitor retained by the current council to review the matter and advise whether or not we should pay the legal invoices. The solicitor retained advised we should pay the bills of the other solicitor retained.
I am suing the Banner, the former Mayor and five others. That is not a new action. It is believed their fees are being indemnified by the town's insurance company
They are not being sued as Councillors. But they are being sued as a result of legal action taken against me at base cost of $70,000. of public resources in 2009.There were ancillary costs as well.
My suit cites abuse of public resources among other things.Details are a matter of public record registered in the court at Newmarket..
That's all I know about legal proceedings currently afoot. None of it related to town business. All of it to do with abuse of one sort or another.
None of it new.
Now we might finally have an opportunity to learn if any of those attending that closed meeting have 'misremembered' what was said and done by whom. I wish I knew how to set up one of those English betting pools so that we could have a chance of making some money instead of always having to pay it out.

ReplyDeletePoor Bob. He was Deputy-Mayor but Morris sent her friend who was unelected to Region Meeting[s]. Don't even know if that was legal.
ReplyDeleteDoes anyone know if McRoberts is helping with the case against Morris? It would certainly be fitting if he were involved in trying to collect some of the loot back.

Can't comment on WIlson, but Granger is still in town.
I think that they are both doing what they should do, they lost - they have gone back to their previous non-political life.
