Did anyone mention if an application has been filed to fence
off the Park for the Jazz event? Not sure if it would be legal but the clock is
running on that event. They really need to get their house in order for July.

I have seen a copy of the permit application for use of the bandshell and three areas of the park.
The application is made and signed by Sher St. Kitts.
The permit is for use of the park. No user fee is charged.
The permit is for use of the band shell. The user fee is charged.
There is no reference to a permit applied for or granted to erect a fence around the park or any part of the park.
There is no place on the form for such a permit application. Or fee to be charged to erect a fence.
The parks bylaw states only the director has authority to erect a fence.
The parks bylaw makes no reference to any party being allowed to rent space to vendors to do business within the park.
The parks bylaw states only the director has authority to contract with food vendors to provide food in the park.

I hate to beat this dead horse but we are talking about a precedent and it matters. If the fence is allowed to go up again and vendors are sold permits to sell, anyone else can do the same. A councillor mentioned selling sunglasses in the Park as an example. I see no reason why a vendor doesn't do just that. Aurora seems unwilling/unable to stop this nonsense. Most of us would not allow your kids to try and sell lemonade in the Park. This is just plain WRONG.
To continue beating this poor horse.... If you want to talk about precedence, they have done it before. They have not been told to do it this time, have they? I would think that precedence is in their favour.
An Academic Question: Why would a vendor pay a fee to Aurora's Chamber of Commerce for permission to sell in the Street Sale when it could set up in the Park for no fee at all?
We recently had a couple of by-law officers at the door requesting we remove the rocks we had placed out to keep construction trucks from parking on the grassy verge. They were quite firm in their authority. Would they require a special order from council to stop the erection of that fence? Or could they simply act on their own?
If the Jazz Gang got really angry with Aurora, maybe they would move elsewhere. That would free up a weekend for the Birthday Party?

That's the problem. You can't have one group setting rules that no other group can follow. Two-tiers of Aurorans.
Yeah, sure. Name a town dumb enough to give them a park to rent spaces to outside vendors. They aren't going anywhere.
This is like when Al Capone went to jail for tax evasion. Aurora would likely back off if the fence were not erected - the outside vendor problem could be dealt with later. It is their loss leader - they should play it and hope that no one pursues the money trail. Could buy them another year.
I did hear they had tried in Richmond Hall. Sorry, can't remember who said it but it was within the past year or so.
WHY do they need the fence? It must cost a heck of a lot and serves no purpose that I can see besides irritating the neighbours who have to look at the damn thing.
